The Design-Build approach is one of Titan’s preferred construction methodologies because of its ability to facilitate project delivery and achieve cost efficiencies. With Design-Build, the Owner has one contract with Titan to oversee both design and construction, greatly simplifying the overall process and providing a single point of contact and accountability on every aspect of the project.

How Can This Effect You?

Over the past several years there has been increased litigation with regards to ADA compliance in specified building classes. This concerning trend has owners and property managers on alert. Identifying non-compliant conditions can be confusing to say the least this may have adverse effects on choosing the wrong method to cure your compliance issues.

Since this trend started in 2008, property owners have entered into consent decrees mandating resolution for compliance. Our clients have hired Titan to assess the unknowns and to provide creative and cost effective solutions to mitigate their risk/cost to comply with current ADA compliance regulations.

Requirements under The Federal Fair Housing Act For New Buildings In 1988, Congress passed the Fair Housing Amendments Act which expanded the coverage of Title VIII of the Civil Rights Act of 1968, commonly known as the Fair Housing Act, to prohibit discriminatory housing practices based on, among other things, disability.

Pursuant to those amendments, the Act now makes it unlawful to deny the rental or sale of a dwelling unit to a person because that person has a disability. The Act also imposes design and construction requirements on buildings that are ready for first occupancy after March 13, 1991, and have an elevator and four or more units.

For example, the The Federal Fair Housing Act requires:
  • Public and common areas must be accessible to persons with disabilities.
  • Doors and hallways must be wide enough for wheelchairs.
  • An accessible route into and through the unit.
  • Accessible light switches, electrical outlets, thermostats and other environmental controls.
  • Reinforced bathroom walls to allow for installation of grab bars at a later date.
  • Kitchens and bathrooms that are readily accessible to people in wheelchairs.
  • The transition thresholds can be no grater than 1:2 ratio.
  • Electrical Outlets must meet height requirements and wall distances.
  • Compliant vanities and grab bar blocking must be installed.

American With Disabilities Act (ADA) Compliance Review
ADA compliance plans allow public and private organizations to assess their current accessibility and develop individualized programs to remove barriers from their residential buildings and commercial facilities. Titan conducts access audits of your facilities working closely with management so that assessments are formatted to meet organizational needs. Titan recommends priorities for condition remediation based on business intent, available resources, and legal compliance requirements.

Fair Housing Act Compliance Review
Fair Housing Act compliance plan review allows developers to ensure full compliance with federal accessible design and construction requirements of apartments, condominiums, senior housing, and dormitories. Titan conducts plans reviews, construction site inspections, and post-occupancy evaluations of residential developments and advises developers of errors which may require mitigation.

HUD Section 504 Compliance Review
Public entities, as well as private entities receiving federal funds, abatements or subsidies, need to update 504 plans while developing ADA compliance plans. Titan can assist organizations in developing these in a cost-effective and constructive process that includes condition identification through construction management services for corrective or preventative measures.

Access & Compliance Audits
Titan conducts two types of access audits for property owners. One is an “access issues report” that identifies key conditions in a building and any regulatory requirements for their removal. The second is a “comprehensive access audit” that identifies all the architectural barriers in a building or facility and provides budget estimates for their removal. The latter uses Titan’s as a construction manager to execute the remediation, alteration, and capital improvement projects.

Accessible Design Standards Review
Large property owners often establish their own design standards that meet or exceed minimum state and federal requirements. Titan helps developers avoid the common access errors that occur in their projects and recommend universal design standards that may be unique to their properties. On behalf of developers identify access code compliance issues that need to be resolved before construction. Titan conducts plan reviews at all phases of design, from conceptual through construction documents.
